Procedure in the Sale of the State’s Unnecessary Real Estate Property to Legal Entities and Natural Persons

  • The state’s unnecessary real estate property in which no interest has been shown by any of the state’s organizational units or state organizations is offered through a selection procedure for the highest offered purchase price. The price shall be determined on the basis of current expert opinion and shall be increased by the cost of the selection procedure.   • After the consideration and evaluation of the received offers and the selection of the most suitable offer, the unsuccessful applicants are notified and the winner is called on to pay an advance, that is, 30 % of the purchase price.
  • Once the advance is paid, a purchase contract shall be prepared and shall be signed by the Administration’s Chairman. After the purchase contract is signed by the Administration’s Chairman, it is signed by the selected applicant.
  • All copies of the purchase contract must be furnished with certified signatures. For the purchase contract to be valid and effective, it is necessary that the approval clause is granted by the relevant Ministry. The application for the approval clause must be accompanied by the appropriate documents, in particular, by the state’s and the Administration’s acquisition titles to the real estate property (no approval of the relevant Ministry is required pursuant to Section 22(3) of Act No. 219/2000 Coll., on the Property of the Czech Republic and the Republic’s Position in Legal Relationships, as amended).
  • After the approval process is completed by the relevant Ministry, the Administration shall issue an invoice for the remaining portion, that is, 70 % of the purchase price. Once it is paid, the Administration shall send an application for entry in the Land Register.
  • Once the entry of the new owner’s title is permitted, the real estate property shall be handed over on the basis of a Handover Protocol for the real estate property and its appurtenances and equipment.

Procedure in the Sale of the State’s Unnecessary Personal Property to Legal Entities and Natural Persons

  • The state’s unnecessary personal property in which no interest has been shown by any of the state’s organizational units or state organizations is offered through a selection procedure for the highest offered purchase price. The price shall be determined on the basis of current expert opinion and shall be increased by the cost of the selection procedure or may be determined by a professional commission.   • After the consideration and evaluation of the received offers and the selection of the most suitable offer, the unsuccessful applicants are notified and the winner is called on to sign the purchase contract.
  • After the purchase contract is signed by both parties, the buyer is issued an invoice after the payment of which the personal property is handed over to him.
